In these terms, “NuPath”, “we”, “us” and “our” mean NuPath Oy. References to NUSwift and its products identify offerings presented by NuPath; they do not identify a separate contracting party. These terms apply to nu-path.eu and to the NuPath pages at nupath.framer.website where these terms are displayed.
2. Scope of these terms
The website is primarily intended for business and professional users evaluating fibre-optic sensing, event analytics, operational monitoring, system integration and deployment services. You must use the website lawfully and consistently with these terms.
A website description, demonstration, indicative specification or request for a quotation does not itself create a supply contract. Prices, licences, acceptance criteria, warranties, service levels, support, data processing and payment terms must be agreed separately. An enquiry does not oblige you to purchase or oblige NuPath to accept an order.
3. Permitted use
You may browse the website and download or share materials made available for that purpose for your own evaluation and internal business use, keeping relevant copyright and attribution notices. Other uses may require permission, subject to rights and exceptions provided by law.
· Do not introduce malicious code, interfere with availability or attempt to bypass access controls.
· Do not access non-public data, accounts or systems without authorisation, or test them for vulnerabilities without prior written permission.
· Do not submit unlawful material, impersonate another person or disclose information you are not entitled to provide.
· Do not collect personal data from the website for unlawful use or imply that NuPath endorses you or your services.
4. Technical information and monitoring limitations
Our website describes applications of the NUSwift family, including Echo, Thermo, Trace, Insight and DigiEye. Illustrations, interface examples and use cases explain potential configurations. They are not a statement that a particular configuration is installed, available or suitable for every site.
Range, resolution, classification accuracy and response time depend on the equipment, fibre installation, environmental conditions, calibration, connectivity and selected configuration. Project performance and acceptance criteria must be agreed and verified for the relevant site. Monitoring and AI-assisted classification can produce false alarms or miss events.
Website materials do not constitute a safety assessment, regulatory approval or certification for a safety function. Use in nuclear, rail, energy, transport or other regulated environments requires the applicable engineering assessment, authorisation and project requirements. Operational decisions must follow the customer’s approved procedures and the agreed system design.
5 . Intellectual property
Website text, graphics, product materials, software demonstrations, names and logos are protected by applicable intellectual property laws and may belong to NuPath or other rights holders. Access to this website does not transfer ownership or grant a licence to NuPath software, source code, patents or branding.
You must not reproduce or adapt substantial website content for commercial publication, remove ownership notices or use our branding in a misleading way without permission, unless the law permits the use. 6 . Enquiries and information you provide
Provide accurate contact information and submit information only if you are entitled to share it. Please use the initial contact form to describe your requirements at a general level. Do not include passwords, access credentials, personal records, detailed security arrangements or sensitive infrastructure drawings.
Where confidential technical information is needed, contact us first to agree an appropriate exchange channel and any confidentiality agreement. An unsolicited message does not by itself create a non-disclosure agreement. You retain your rights in materials you provide; you authorise us to use them only as reasonably needed to evaluate and respond to your enquiry, subject to applicable law and any agreed confidentiality obligations.
7 . Links and external services
The website may link to third-party websites or services. Those providers are responsible for their own content, availability and terms. A link does not, by itself, imply endorsement. If an external feature collects personal data or accesses information on your device, the applicable privacy information and consent requirements also apply.

Using the website or sending an enquiry does not constitute consent to unrelated marketing or optional tracking. Where consent is required, we request it separately. Your statutory data protection rights are not limited by these terms.
9. Availability and liability
We take reasonable care over website content but do not promise uninterrupted access or that every page is complete, current or free of error. We may correct information, update content or restrict access where reasonably necessary for maintenance, security or legal compliance.
To the extent permitted by applicable law, NuPath is not liable for indirect or consequential business loss arising from use of this public website or reliance on general website information. This provision does not exclude liability for intentional misconduct, gross negligence or any liability that cannot lawfully be excluded or limited. It does not alter liability under a separate customer agreement or remove mandatory consumer or data protection rights.
10. Changes to these terms
We may update these terms to reflect changes to the website or applicable requirements. The effective date identifies the version that applies. Material changes will be brought to users’ attention by an appropriate website notice. Changes do not retrospectively amend an existing signed agreement.
11. Applicable law and disputes
Finnish law applies to these website terms, subject to mandatory law that protects you and cannot be displaced by a choice of law. Please contact us first if a concern arises. If it cannot be resolved, the competent courts are determined under applicable jurisdiction rules. Any mandatory consumer right to bring proceedings in the consumer’s place of residence remains unaffected.
